Traditional Affairs General Amendment Bill Tabled

The Traditional Affairs General Amendment Bill has been tabled in parliament.

The traditional affairs department published the bill’s explanatory summary in Government Gazette 47061 at the end of July 2022.

Cabinet approved the bill in June 2022 for tabling in parliament.

According to the explanatory summary, the bill proposes certain technical amendments to section 81 of the Local Government: Municipal Structures Act of 1998 and section 16 of the Traditional and Khoi-San Leadership Act of 2019.

References to the Code of Conduct in section 81 are outdated and need to be corrected and, for purposes of legal certainty, it is proposed to amend section 16(3)(a) to provide clarity on which forum has to be consulted by the different leaders.

The bill aims to amend the Local Government: Municipal Structures Act, 1998, so as to:

  • correct certain references to the Code of Conduct;
  • amend the Traditional and Khoi-San Leadership Act, 2019, so as to provide clarity on a forum to be consulted;
  • repeal a section of the Local Government: Municipal Structures Amendment Act, 2021; and
  • provide for matters connected therewith.

The portfolio committee on cooperative governance and traditional affairs will process the bill.
