Traditional Affairs General Amendment Bill Heading for Parliament

The Draft Traditional Affairs General Amendment Bill is heading for parliament.

The traditional affairs department published the draft bill’s explanatory summary in Government Gazette 47061.

Cabinet approved the draft bill in June 2022 for tabling in parliament.

According to the explanatory summary, the draft bill proposes certain technical amendments to section 81 of the Local Government: Municipal Structures Act of 1998 and section 16 of the Traditional and Khoi-San Leadership Act of 2019.

References to the Code of Conduct in section 81 are outdated and need to be corrected and, for purposes of legal certainty, it is proposed to amend section 16(3)(a) to provide clarity on which forum has to be consulted by the different leaders.

The draft bill will be tabled in parliament soon.
