Sectional Titles Act Regulations Under the Spotlight

Sectional Titles Act Regulations have been amended.

The agriculture, land reform and rural development department published the amended Regulations in Government Gazette 44700.

A new paragraph (b) is inserted into Regulation 6.

It refers to a certificate by an architect or land surveyor stating that the boundaries of the sections and common property are physically defined as contemplated in section 5(4) and (5) of the act.

New forms include Form AP, AQ, AR, AS and AT.

In Notice 498, the department published amendments to Deeds Registries Act Regulations.

A new Regulation 16 is inserted.

It stipulates that the Chief Registrar of Deeds shall keep an electronic register of conveyancers and notaries that must be accessible to all registrars.

Registrars must also keep a register of persons other than conveyancers and notaries authorized by any other law to prepare a deed or other document for registration or filing in a deeds registry.

New subregulations 11(B) and 11(C) on cancellation of bonds are also inserted.

A new Form V on Certificate of Township Title is also set down.

Both sets of Regulations come into effect one month from the date of publication.
