Rules Regulating the Conduct of Magistrates’ Courts Amended

Rules regulating the conduct of the proceedings of magistrates’ courts have been amended.

The justice and constitutional development department published the amendments in Government Gazette 47055 in terms of the Rules Board for Courts of Law Act.

A new paragraph 1 is inserted into Part 1 of Table A of Annexure 2 to the Rules.

Reference to the amount in dispute of R7 000 and scale A is removed.

Part II of Table A of Annexure 2 gets a new item 2 on summons for a claim not exceeding R10 000.

A new item 2A on simple summons and item 3 on judgement are inserted.

The amended Rules come into effect on 24 August 2022.
