Rules on Conduct of the High Court Amended

Rules regulating the conduct of the proceedings of the high court have been amended.

The justice and constitutional development department published the amendments in Government Gazette 46475.

The amendments were drawn up in terms of the Rules Board for Courts of Law Act.

A new Rule 37B on administrative archiving is inserted.

A new heading, namely, “Legal assistance to indigent persons” is inserted into Rule 40.

Rule 38A on referral of particular matters for investigation by referee is also inserted.

The amendments come into effect on 8 July 2022.

Other notices include:

  • Notice 2134 – Rules Board for Courts of Law Act – amendment of rules regulating the conduct of the proceedings of the magistrates’ courts – in effect on 8 July 2022; and
  • Notice 2135 – Rules Board for Courts of Law Act – amendment of rules regulating the conduct of the proceedings of supreme court of appeal – in effect on 8 July 2022.
