Road Traffic Management Corporation Regulations Published

Road Traffic Management Corporation Regulations have been drawn up.

The transport department published the Regulations in Government Gazette 45738 in terms of the Road Traffic Management Corporation Act.

The Regulations focus on services and transaction and service fees.

They stipulate that the Corporation can provide development, maintenance and operation of the NaTIS services.

Other services that may be provided include law enforcement; NaTIS online convenience services and collecting agency services.

A transaction fee of R72 is set down for development, maintenance and operation of the NaTIS services.

Service fees for NaTIS online convenience services are also set down.

Regulations published in 2007 are repealed.

The Regulations come into effect 30 days after the date of publication in the Gazette and every Provincial Gazette.

Meanwhile, in a statement, the department pointed out that the transport minister, Fikile Mbalula, has “noted the judgement handed down by Judge Basson at the Pretoria High Court on 13 January 2022 declaring the Administrative Adjudication of Road Traffic Offences Act and its subsequent Amendment Act unconstitutional and invalid”.

The act sought to set up a Road Traffic Infringement Agency; set out an adjudication procedure and implement a points demerit system.

The amendment act, signed in 2019, aimed to improve how documents were served on infringers; put rehabilitation programmes in place and set up the Appeals Tribunal.

The department added that the minister is studying the judgement and a decision will be taken on whether to appeal the judgement or not.

In terms of parliament, the portfolio committee on transport, in a statement, also noted the judgement.

According to the committee chairperson, Mosebenzi Zwane , the committee will read the judgment and discuss the matter with the department.
