Department of Environmental Affairs
Regulations Regarding the Control of the Import or Export of Waste have been published.
The environmental affairs department published the regulations in Government Gazette 42175.
They were drafted in terms of the National Environmental Management: Waste Act of 2008.
Draft regulations were published for comment at the end of 2017.
The regulations set down procedures and control measures for the import, export and transit of waste and also ensure “cradle-to-cradle” management in the transboundary movement of waste.
The regulations do not apply to the export of ferrous and non-ferrous waste and scrap; the offloading of waste generated via the normal operation of ships and offshore platforms; galley waste generated on board ships, vehicles, trains and aircraft and second hand goods.
Included in the regulations is detail on prohibitions, requirements for applications for the import, export or transit of waste, decisions of the department, requirements for the transboundary movement of waste and record keeping.
The department will issue decisions in the form of a consent.
The regulations come into effect on a date still to be determined by the environmental affairs minister.
