Promotion of Access to Information Act Guide Updated

The Information Regulator has updated the Promotion of Access to Information Act Guide.

The justice and constitutional development department announced the update of the Guide in Government Gazette 45492.

According to the department, the Guide was initially drawn up by the South African Human Rights Commission to enable any person “who reasonably wishes to exercise any right” contemplated in the act.

Meanwhile, in Gazette 45482, the Legal Practice Council published amendments to the Code of Conduct in terms of the Legal Practice Act.

An amendment to Clause 13 stipulates that an “attorney, other than an attorney referred to in section 34(5) (c), (d) and (e) of the Act, may not, without the prior written consent of the Council, share offices with a person who is not an attorney or an employee of an attorney or a trust account advocate”.

A new Clause 25.9 stipulates that Counsel may not share offices with a person who is not a Counsel unless prior written consent of the Council is obtained.

A new clause 41.6 sets down that a trust account advocate may not share offices with a person who is not a trust account advocate or a practising attorney or an employee of an attorney unless prior written consent of the Council is obtained.
