National Research Foundation Exempted from MPRDA

The National Research Foundation (NRF) has been exempted from certain provisions of the Mineral and Petroleum Resources Development Act.

The mineral resources and energy department published the exemption in Government Gazette 42839.

The exemption was granted in terms of Section 106(1) of the act.

According to section 106(1), the mineral resources and energy minister “may, by notice in the Gazette, exempt any organ of state from the provisions of sections 16, 20, 22 and 27 in respect of any activity to remove any mineral for road construction, building of dams or other purpose which may be identified in such notice”.

The NRF is exempt from sections 16, 20, 22 and 27 of the act.

Section 16 refers to application for prospecting right, 20 to permission to remove and dispose of minerals, 22 to application for mining right and 27 to application for, issuing and duration of mining permit.

The exemption is in respect of any activity by the NRF to remove any mineral within its area of jurisdiction for the construction and maintenance of roads and infrastructure as part of the Square Kilometer Array (SKA) Project.

SKA SA is a project of the science and innovation department, administered by the NRF.
