Mine Health and Safety Bill Drawn Up

The Draft Mine Health and Safety Amendment Bill has been drawn up.

The mineral resources and energy department published the draft bill in Government Gazette 46546 for comment.

The draft bill aims to amend the Mine Health and Safety Act, 1996 so as to:

  • streamline administrative processes;
  • strengthen enforcement provisions;
  • reinforce offences and penalties;
  • amend certain definitions; and
  • provide for matters connected therein.

Proposed amendments focus on, inter alia, appointment of chief executive officer; investigation by employer; findings of unfitness to work; payment of fines; employer’s duty to report dismissal based on unfitness to perform work and a new definition on mining area.

Comment is invited until 29 July 2022.
