Legal Practice Council Rules Amended

Legal Practice Council Rules have been amended.

The Legal Practice Council published the amended Rules in Government Gazette 45500 in terms of the Legal Practice Act.

Amendments to Rule 30.4.4.2 stipulate that, where an advocate is applying to convert his or her enrolment to that of an attorney, a “statement indicating whether he or she intends to practise as an attorney and, if so, whether he or she intends to practise for his or her own account or as a partner in a firm of attorneys or as a member of a professional company” must accompany the application.

An amendment to Rule 32.2.2 on applications by advocates referred to in section 34(2)(a)(i) to convert enrolment to that of an advocate referred to in section 34(2)(a)(ii) stipulates that applicants must, within one year of possession of a Fidelity Fund certificate, complete a legal practice management course approved by the Council.

An amendment to Rule 47.7.1 stipulates that Fidelity Fund certificates will not be issued until the course is completed.
