Legal Practice Council Rules have been amended.

The Council announced the amendment in Government Gazette 44427 in terms of section 95(1) and (4) of the Legal Practice Act of 2014.

A new Rule dealing with electronic accounting records or files hosted offsite is inserted.

The amendment stipulates that “such records or files shall always be kept confidential, shall be reasonably secured and shall remain immediately accessible to authorised persons from the office of the firm, [and] to the Council, and to all persons entitled to access thereto by law”.

Service providers that provide offsite storage facilities for the records and files of firms will also need to comply with the requirements.

Meanwhile, in Gazette 44434, the justice and constitutional development department published amendments to the Terms of Reference of the Commission of Inquiry into Allegations of State Capture, Corruption and Fraud in the Public Sector including Organs of State.

The Commission now has until the end of June 2021 to submit its report and recommendations to president Ramaphosa.

The Pretoria High Court in February 2021 ordered the extension following an application to extend from the Commission.
