January 28, 2021

Department of Agriculture, Land Reform and Rural Development

Genetically Modified Organisms Act Regulations have been amended.

The agriculture, land reform and rural development department published the amended Regulations in Government Gazette 44102.

The Regulations were published in 2010.

They focus on, inter alia, authority to conduct an activity, applications and decision-making, scientifically based risk assessment, socio-economic considerations, environmental impact assessment, risk management, registration of a facility, notification of an accident, provisions with regard to appeal and matters concerning the biosafety clearing house.

Regulation 9 on public notification of proposed release or commodity clearance of genetically modified organisms is amended by the addition of sub-regulation (8).

It stipulates that the “provisions of regulation 9 do not apply to applications made in respect of genetically modified organisms aimed at addressing, preventing and combating the spread of a pandemic in an instance where a national state of disaster has been declared”.
