Draft Regulations for Aliwal Shoal MPA Drawn Up

August 20, 2020

Department of Environment, Forestry and Fisheries

Draft Amendments to the Regulations for the Management of the Aliwal Shoal Marine Protected Area have been drawn up.

The environment, forestry and fisheries department called for comment on the draft amendments in Government Gazette 43618.

The regulations were drafted in terms of the National Environmental Management: Protected Areas Act.

According to the notice, the primary purpose of the proposed amendment is to delete regulation 10(3) of the current Aliwal Shoal Marine Protected Area (MPA) Regulations.

Aliwal Shoal MPA was re-declared as part of the Phakisa network of MPAs in 2019.

“Regulation 10(3) was inserted after the public participation process, but affected stakeholders were not afforded an opportunity to comment on the new regulation. The proposal is therefore to withdraw that regulation.”

Regulation 10(3) refers to the volume, quantity or constituents of an existing discharge that may not increase by more than 5%.

Comment is invited within 60 days of the date of publication.
