Draft Legal Practice Act Regulations Drawn Up

Amendments are proposed to Legal Practice Act Regulations.

The justice and constitutional development department published the Draft Regulations for comment until 17 May 2021.

Drawn up by the South African Legal Practice Council, amendments are proposed to Regulation 2.

A new subregulation (2) stipulates that the “election of members of the Council referred to in subregulation (1) must be conducted under the authority of the Council”.

A new subregulation (4) is also proposed outlining the timeframe for elections for Council members, how elections are to be conducted, the appointment of an independent electoral service provider, nominations for election to council and by-elections to fill vacancies.

A new subregulation 25A on the electronic voting system is proposed.

A new Annexure A on ballot paper – attorneys and Annexure B on ballot paper – advocates is also proposed.
