Disaster Management Act Regulations Amended

Disaster Management Act Regulations have been amended.

The cooperative governance department published the amended Regulations in Government Gazette 44130.

Chapter 7 on hotspots has been deleted.

A new Regulation 32 on application of alert level stipulates that the Regulations apply during adjusted Alert Level 3 throughout South Africa and in areas declared as hotspots.

A new Regulation 33 on movement of persons is inserted.

It stipulates that the curfew now applies from 23H00 until 04H00 daily and closing time for establishments such as cinemas, theatres, casinos, museums, beaches, game parks and restaurants is 22h00.

Regulation 33A on opening and closure of schools is inserted.

It stipulates that the basic education minister can determine dates on which schools may be opened or closed to combat Covid-19.

Other amendments include gatherings at faith-based institutions to be limited to 50 persons or less for indoor venues and 100 persons or less for outdoor venues; beaches, dams, lakes and rivers to be open; night clubs remain closed; sale of liquor by a licensed premises for off-site consumption permitted from 10h00 to 18h00 from Mondays to Thursdays and by a licensed premises for on-site consumption permitted from 10h00 to 22h00; registered wineries, wine farms, micro-breweries and micro-distilleries to continue to offer wine-tastings and other brew-tastings and selling for off-site consumption and transportation of liquor permitted.

A new Table 2 on adjusted Alert Level 3 and areas declared as hotspots is inserted.

Specific exclusions including night vigils, all social gatherings, night clubs, passenger ships for international leisure and attendance at sporting events are set out.

The amendments came into effect on the date of publication.
