Comment on Regulations on Certificate of Need Extended

Comment on the Draft Regulations Relating to Certificate of Need for Health Establishments and Health Agencies has been extended.

The health department published the draft Regulations in Government Gazette 44714 for comment on 15 June 2021 in terms of the National Health Act.

Section 39(1) of the act focuses on regulations relating to certificates of need.

The act stipulated that health establishments or health agencies need certificates of need in order to operate.

The draft Regulations focus on, inter alia, application for certificate of need, duration of certificate of need, requirements for issuing certificate of need for a health establishment, requirements for renewal of certificate of need, re-application for certificate of need, rooms required for general health establishments, accommodation, furniture and equipment and private hospitals.

According to the draft Regulations, a certificate of need will be valid for 20 years from the date of issue unless the department withdraws it.

Certificates of need, once issued, will need to be “displayed in a conspicuous place on the premises of the health establishment or health agency”.

In Gazette 44873, comment is invited until 15 August 2021.
