March 23, 2022

Department of Employment and Labour

The Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace is in place.

The employment and labour department published the Code of Good Practice in Government Gazette 46056 in terms of the Employment Equity Act.

The Code was published for comment in August 2020.

It is designed to eliminate all forms of harassment in the workplace and in any activity linked to or arising out of work.

The Code sets out the steps that employers must take to eliminate harassment including the development and implementation of policies, procedures and practices to facilitate workplaces free of harassment where employers and employees respect one another’s integrity, dignity, privacy and the right to equality in the workplace.

The Code defines harassment; sexual harassment and racial, ethnic or social origin harassment.

The Code came into effect on the date of publication.
