Claims Limit for Small Claims Court Increased

The maximum amount that can be claimed in the Small Claims Court has increased to R20 000.

The justice and constitutional development department published the adjusted amount in Government Gazette 42282.

The determination was made in terms of the Small Claims Courts Act of 1984.

The increase comes into effect on 1 April 2019.

The claims limit was last adjusted in 2014 when it was set at R15 000.

Speaking recently, the deputy minister of justice and constitutional development, John Jeffery, declared that the “proposed increase is in the interest of access to civil justice and will further assist our people to have their legal matters resolved”.

He described Small Claims Courts as “seeking to improve access to justice and make civil justice inexpensive and accessible to those who cannot afford litigation in the ordinary civil courts”.
