Chapter 4 of Social Assistance Act Under the Spotlight

Chapter 4 of the Social Assistance Act comes into effect on 1 April 2021.

The commencement of Chapter 4 (Sections 24-28) was announced in Proclamation 2 published in Government Gazette 44299.

The act was signed in 2004 and came into effect, apart from Chapter 4, in 2006.

The act aims to:

• provide for the rendering of social assistance to persons;
• provide for the mechanism for the rendering of such assistance;
• provide for the establishment of an inspectorate for social assistance; and
• provide for matters connected therewith.

Chapter 4 focuses on the Inspectorate for Social Assistance including its independence, funding and employees, functions and power to request information and to subpoena.

The Social Assistance Amendment Act of 2020 provided for the setting up of the Inspectorate as a government component.
